Data protection notices for products subject to declaration

This notice supplements our Privacy Policy for orders of products whose supply requires a declaration or additional evidence. The controller is Biogo S.A., Szewska 18, 50-139 Wrocław, Poland; contact: kontakt@biogo.de.

Depending on the product, we process details of the ordering person and, where applicable, their representative, contact details, company data, details of the product and quantity, the intended purpose of use, professional use or legal authorization, as well as the details and signatures in the required declarations and evidence. We collect other data only to the extent necessary for the product concerned.

We use this data to send documents, verify eligibility to purchase and the purpose of use, decide whether to accept the order, and comply with statutory documentation and reporting obligations. Where the ordering person is themselves the contracting party, the processing for the purpose of initiating and performing the contract is based on Art. 6(1)(b) GDPR. For legal obligations, Art. 6(1)(c) GDPR applies. For communication with representatives and the assertion or defense of claims, Art. 6(1)(f) GDPR applies.

We may use the telephone number provided with the order to send an SMS informing about the dispatch of the required documents. This message serves to process the order and contains no advertising. Access to the documents is granted to the persons responsible for this; where necessary, data is passed on to contracted service providers and, due to statutory obligations, to the competent authorities.

The retention period depends on the regulations applicable to the respective product and the information concerned. Information under Art. 8(1) and (2) of Regulation (EU) 2019/1148 is retained for 18 months from the transaction. The documents and records referred to in Art. 5(1) to (4) of Regulation (EC) No. 273/2004 are retained for at least three years from the end of the calendar year of the transaction. Where § 9 ChemVerbotsV applies, the required handover book and receipts are retained for at least five years after the last entry. Information required to fulfill obligations under Art. 36 REACH is kept for at least ten years after the last supply of the substance or mixture concerned. If the same information is subject to several relevant obligations, the correspondingly longer required period applies.

If a purchase contract is not concluded, we process the data until the review and any refund are completed. After that, we delete it unless its further retention is required due to a specific legal obligation or for the assertion or defense of claims.

Without the details and evidence required for the respective product, we cannot verify eligibility to purchase and cannot accept the order for that product. The decision on acceptance is reviewed by responsible persons and is not made solely by automated means.
